12. Dispute Resolution

12.1 Informal Resolution

Before initiating any formal proceedings, you agree to first contact us at legal@globalbluehealth.com to attempt to resolve any dispute informally. We will try to resolve the matter within 30 days.

12.2 Binding Arbitration

If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in the State of Florida. The arbitrator’s decision shall be final and binding.

12.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

Either party may bring an action in court for injunctive relief related to intellectual property infringement or misappropriation without first engaging in arbitration.

We may terminate or suspend your access to the Site and services immediately, without prior notice or liability, for any reason, including if you breach these Terms.
